Photoshoot Terms and Conditions

“The client(s)” shall be the persons confirmed in the booking form. In the following terms & conditions “the photographer” shall mean Gemma Calderon Dog Photography. It is mutually agreed that the following terms of agreement form an integral part of this contract and cannot be varied in any way by the client(s) unless such conditions are expressly agreed by the photographer in writing. By booking with the photographer you agree to the below Terms and Conditions.

Copyright

Gemma Calderon Dog Photography owns all photographic copyright of all images supplied. All rights belong to the photographer. Gemma Calderon Dog Photography reserves the right to use any photograph in any such form. By proceeding with the photo session the client shall give the photographer permission to license and use the content in any media for any purpose which may include advertising, promotion, marketing, packaging and product , art and service. 

Display

The client(s) hereby allow(s) the photographer to display any photographic images covered by this contract and to generally promote the business in advertising, brochures, magazine articles, calendars, websites, photo competitions, sample albums, commercial photography, etc. Images may be combined with other images, text or graphics, film, audio, visual works and may be cropped, altered or modified. The photographer will aim to keep the photographs safe from any malicious activity and cannot be held liable or accountable for malicious actions carried out by other persons. 

Use of your images on the web/ social media

As the client, when uploading your images on the web or on social media platforms you will be required to only use the small resolution digital image with photographer’s logo. You are not permitted to remove the logo or edit the images (changing colours, or removing part of the image). High resolution images (JPEG) without logo are for print only use. You cannot enter any of your images in competition (online or otherwise). Prints – When purchasing prints, you cannot scan the print into another print or a digital image. You can purchase the digital images separately.

Welfare

The photographer has the right to stop the session if they are concerned about the dog’s/ photographer/ clients welfare, safety or behaviour during the session (no refunds provided).

Image Manipulation

The Images remain the rights of the photographer. As a product of the service provided the images are no to be manipulated in any way as this misrepresents the photographers work and changes the final product, which can impact the photographers representation. I therefore understand that I am not to edit, manipulate or filter images in any way. 

Personal accident

Any directions issued to clients or their guests during a photoshoot are deemed to be at said persons own risk. The photographer cannot be held responsible for any personal accidents during a photography shoot. The photographer cannot be held responsible for the dog’s safety, the client shall be responsible for the welfare of the dog at all times. The photographer cannot be responsible for any vehicle or personal items belonging to the client. 

Photographs

All images supplied by Gemma Calderon Dog Photography are produced to the highest standards using the best quality materials. However, all images will, in time fade. This is particularly true if they are left if bright sunlight and are not behind sun protected glass. The Photographer cannot accept responsibility for gradual image deterioration.

Products

Your chosen products from your photo gallery will be ordered once payment is received. You will not entitled to a refund of the session if you do not wish to purchase any images.  Once an order has been placed during your ordering session, it cannot be cancelled, amended or refunded. Products will be ready for collection within a reasonable timescale (up to 6 weeks, but usually less from order date) once received from the print lab.

 Digital Files

When the client purchases digital files, the client is responsible to keep them safe and to make duplicates. Any request for additional digital image duplicates from the photographer will incur additional charges. Digital files are provided as JPEG only, edited in my style and are not to be manipulated in any way as stipulated above.

 Weather

For outdoor photography shoots affected by adverse weather conditions, Gemma Calderon Dog Photography has the ultimate decision if the sessions needs to be rescheduled. If the photographer has to reschedule your shoot due to weather conditions or any other factors, you will be notified at the earliest convenience personally, by phone or in writing and available dates will be sent to you to reschedule.

Pricing

Session fee or a deposit is required at time of booking. Your booking is only secured upon receiving full session fee (session fees are non refundable). All package cost must be paid in full no later than one week before the session. The session will not go ahead until full payment has been received. If a payment plan is required, this can be arranged leading up to your session- please ask for details. Should you wish to purchase additional goods post shoot, these need to be paid at the time of order. Goods will not be released until full payment has been received. All services and/or goods are supplied at the current prices guide at the time of each individual payment and are subject to change without prior notice.

No Show

If for any reason after receiving your confirmation, you fail to attend your pet portrait appointment, you will lose your full booking fee. 

Cancellation Policy

Clients reserve the right to reschedule a photo session with at least 3 weeks notice to the photographer in writing, at no additional fee. Rescheduling the session less than this period may incur additional fees. The client may cancel this contract at any time by giving written notice to the photographer. But in doing so will forfeit any monies paid. If the Photographer has to cancel the appointment for reasons beyond their control (death, injury, sickness, etc.), their liability shall be limited to a full refund of all monies paid. 

Refund Policy

The photographer will not refund, nor accept the return of/refusal to pay charges for, any technically acceptable photograph supplied either in print or in electronic format. No exception can be made as we cannot be held responsible for individual tastes or exceptions.The Photographer will keep your images on file for six months after which your images may be deleted.

 Complaints

Any complaints should first be raised by the client with the photographer in writing within 14 days from the date of receipt of images.

 Other

No dogs in season

Cameras of any kind are not permitted at your dog’s shoot.

The Photographer reserves the right to amend these Terms and Conditions without prior notice.
